Now it's Sun that is asking for all notices of every kind, formal or informal, written or oral, in the SCO bankruptcy. Oh, and Missouri would like its tax money. So I'm seeing that there will indeed be a creditors' committee. But who will get to chair the committee? When the creditors meet, it's going to be like dinner with a large and seriously dysfunctional, complicated and nuancedly neurotic family, where the siblings will discuss how to divide up fairly their recently deceased mother's personal effects, some of which have already mysteriously disappeared. I wonder if they do this routinely or does SCO has some specific assets or
operations in Texas and Missouri?
I can't imagine what taxes, beyond some sales tax would be due those two states
otherwise.

Isn't Missouri the "Show me" state? Fitting for MIssouri
to interest in SCO. Seems like SCO has quite a bunch of
people interested in getting money owed to them. I'm
certainly no expert, but I don't recall ever seeing mention
of so much debt in any of SCO's filings. Perhaps others
have?

My *guess* is that Sun will make the point that SCO sold
property that did not belong to it and therefore:
1) The deal is null and void.
2) Sun should get its money back.

Why would Sun be joining the party? They paid money - I would not think they are
creditors.
Could it be that they are planning on saying "Since what you 'sold' us you
had no rights to, we want our money back"?
Naaaah - we couldn't be so lucky to have that amusing event happen....

fiasco that is not present.

Novell served their documents on Ellen W. Slights, Esq., Assistant US Attorney
in the Wilmington, DE office.
They also served the Attorney General, several SEC offices, and so on. A quick
search shows that this is not unprecedented, but it does not seem to be the
norm. One wonders what hilarity may ensue.

Could it be that SCO did not pay taxes on the monies received for Novel? I
believe if these monies were destined for a trust to somebody else, they would
not have to. Then they spent the monies, and now owe the IRS.
Another possibility, is that if Novel could not recover the monies, they may be
able to deduct the loss, just like a stolen and unrecoverable asset.[ Reply to This | # ]
