OpenLinux 3.1.1 Still Available, with the 2.4 kernel

Guess what? I'm told you can still download Caldera's OpenLinux 3.1.1 from the Internet. Yup. OpenLinux is still marching on, thanks to that perfect license the GPL, right here:

I'm making a public record here of what is in that distro, because there might be some lawyers out there who'd like to have proof that the 2.4 kernel was released by Caldera under the GPL and that they never pulled this one back. There's no legal notice that this is only for SCO customers or any nonsense like that. It's available to the public. And the public is interested too. That's what we do here on Groklaw, collect evidence and then tell the world. If you put this information together with Ralf Flaxa's Declaration, well, there you are. I believe SCO loses.

Here's the thing. My understanding is that Planet Mirror doesn't just grab people's stuff and mirror it. As you can see in their policy page, a vendor has to request it. So, at some point in time, judging by the dates on January 29 and 30, 2002 (Cf. http://public.www.planetmirror.com/pub/caldera/OpenLinux/3.1.1/Workstation/?fl= ), I gather Caldera/SCO must have asked Planet Mirror to make this distribution available to the world. If that is correct, I'm guessing Planet Mirror might have a record of that. And since it's still there, it looks like that request was never revoked by SCO.

And here's one more piece of evidence that Caldera was very interested in Linux being useful in the enterprise that I just found. It's all about OpenLinux eBuilder Enterprise Edition, from 2000. Now, let me show you the contents of the downloadable OpenLinux, and it's quite a long list, so I've marked the kernel in red, as well as binutils and Flaxa/Caldera's Lizard. Man pages are included of course. I believe you will find all the methods and concepts you can eat in there.

Here's the complete list of what is in the distribution (the Workstation -- the Server is available too), so SCO can't say they had no idea what they were distributing -- excuse me, what they *are* distributing:

I see no form which would allow SCO to revoke a request. Nor is there evidence
that PlanetMirror would remote material if the request was revoked. The GPL
license grants permanent permission to redistribute.

And the form doesn't require you be the owner to mirror it, but I suspect they
were just mirroring Caldera's GPL directories from whenever they got the
request.

Thank you for this 'hit' PJ. Most excellent detective work. I am prepared to bet
that SCO/Caldear had fogotton about this or that thier external legal team may
not have even known about it.

The plot thickens a little if you look at the 'update' date: September 2003.
Assuming that only SCO could update these files then someone in SCO modified
these files after the law sit was filed.

The modifications dont seem to amount to anything as far as I can see - please
feel free to correct me. Also it is possible that SCO did not modify these
files.

But on the face of it it looks like SCO chose to distribute Linux in 2002 on
Planet Mirror, filed a suit and then continued to distribute Linux on Planet
Mirror and that they knew about its presence on Planet Mirror in September 2003.


They are still (2006) distributing Linux under thier own brand and it is
available to anyone not just thier customers. There is no argument about
'unclean hands' here as was earlier raised in the IBM case.

Its simply a great find. Thanks again PJ.

I have a purchased copy of OpenLinux 2.2 and 2.3 upgrade, as well as the manuals
and for what it is worth the binutils-2.9.1.21, and linux-2.2.10 as well as
lizard and all the rest were in there. The manuals talk about open source and
the GPL and the GNU utilities These are dated 1999 and the 2.2 version is also
1999. If more detail is useful I can provide it or donate the whole set to an
archive. Anything to help the cause, well almost anything.

Well since we purchased a copy of the distribution and still run it for our mail
server, I would think they have a requirement to keep it available under the
GPL. I would expect it, yea even demand it. What is so remarkable about that?

No JFS

Well, this distro does not appear to include JFS. That got moved into the
2.4.18 kernel, and this one is still at 2.4.13. That should not be taken as an
indication that I believe that Mr. Yarro's cause is anything other than
"utterly" lost. I'm just sayin' that you don't actually want this
distro because it is old and out of date.

I thought Caldera told the court that it had *ceased* distribution of Open
Linux. Really, I'm quite sure I just read that in one of the SCOundrels' recent
filings.... Maybe they figure Planet Mirror will have to pay IBM for Caldera's
violation of the GPL.

The Flatlander

There are three lessons here, at least: 1) If you need a lawyer, you don't want
BS&F; 2) If you are a lawyer and you need clients, you don't need 'em badly
enough to take on Caldera; 3) Thrity MILLION dollars doesn't buy as much
[competent] lawyering as you might have hoped or guessed.

Here's a hypothetical, but probably rather realistic question to ask (IMHO -
IANAL)-

Presume the court awards the case to IBM, and awards damages.
IBM gets awarded $x million. More than SCO is worth.

Just for the sake of argument. Then SCO goes bankrupt.

BUT... and here is the interesting question--

Would IBM share some of the winnings (whatever is left of the SCO carcass) with
Novell?

From my reading, I'm not sure they are required to, or perhaps at least the
licensing stuff. But I'm more interested in is this next question--

Would IBM give any extra funds out of this to Novell as a "courtesy"
for their part in the case, to help off-set all the fees these two have been
collecting?

I know they don't have to, but I can see something happening here. Perhaps even
some joint IBM/Novell business partnerships to do with Linux, etc.

Think about what these two could do with SUSE, etc...

And in my computer room I have all of the Caldera releases from Caldera Network
Desktop 1.0 through the Caldera OpenLinux 3.1.1. And until recently anyway you
could still buy them from CheapBytes and other CD ROM distributors.

Planetmirror is obviously in collusion with IBM & Novell to destroy the
value of SCO's preciousss!

We'll need to stay both IBM and Novell cases while we do about three years of

A while ago, I devised a game called "SCO Snakes and Ladders". I was going to release it at Groklaw and moderate the game. This is how it was intended to work:

How to Enter

  1. Start by typing the top-level address of any SCO-owned website or FTP site into the address field of your browser (eg: http://thescogroup.com/ or ftp://ftp.calderasystems.com/). This is your "Start URL".
  2. Navigate to any full SCO Linux distro available for download (your "Finish URL"), without typing, just using your mouse.
  3. Record each step along the way (your "Safe Route" - see the real example below) and count the number of mouse clicks needed to get there.
  4. Calculate your SCO Snakes and Ladders SCOre according to The Rules (below) and post it with the title "SCO Snakes and Ladders Entry: Please Validate!"", along with your Safe Route description, in reply to this post.

The aim was to get the lowest score possible, but to cut a long story short, it didn't happen and now I'm going to spoil it by publishing the solutions I found :(

There are other instances too, on SCO FTP site(s), but I'm not going to give

How to become a Caldera FTP Mirror Site

A while ago, when I was searching for SCO/Caldera FTP mirror sites, I stumbled
across a very relevant email sent out quite broadly by Caldera, describing how
anyone can become a Caldera FTP site. It was a very simple process. You didn't
have to sign up for anything. You just sent an email to a particular email
address and all the necessary permissions were set up for you to mirror their
FTP site.

I thought I'd saved this email to my harddrive, but I'm danged if I can find it
now. Does anyone else have this? I'm still googling for it, but if anyone has
it, it would save me a great deal of frustration trying to relocate it.

If you are interested in becoming a Caldera OpenLinux FTP mirror
here are the steps:

1) Subscribe to the mirror-list@rim.caldera.com by sending mail to
mirror-list-request@rim.caldera.com with "subscribe" in the
body of the message. This list has very little traffic
so it shouldn't be a burden. This will help us keep coordinated
especially during new releases when there is a lot to mirror.

2) Mirror ftp.caldera.com:/pub/OpenLinux... (nightly, if possible).
Mirror software can be obtained from:
ftp://sunsite.doc.ic.ac.uk/computing/archiving/mirror

3) Allow full anonymous ftp access to your mirror site.

4) Send a note to mirror-list@rim.caldera.com with the URL of your mirror
so it can be listed in the MIRRORS file and on our web site. Also
include the canonical hostname of the machine running the mirror
process (not an alias, and not necessarily the ftp machine) so I
can list it in the special "mirror" class that is never denied
anonymous FTP access to ftp.caldera.com.

5) You can get a good idea of the sizes of various directories by
reading the du-s files. We would especially appreciate it if you
would NOT mirror the mirrors directories from us. Please get those
files from the original source.

The gdb package probably contains the libbfd sources (including the ELF file
loading/saving code) too.

The current version (6.x) does, at least.

OK, we all know that SCO follows GL religiously, so how long before this is
removed from PlanetMirror?

My bet is by 9AM EST on Monday, October 8th.

(and BTW, if you are one of the SCOites following here it is no fair for you to
vote because you know when the request is going to PlanetMirror to have them
remove it)

Not the version in question but a Linux Technology Preview "featuring the new Linux 2.4 kernel preview" from late 2000 (in fact, it is 2.4.0-test3). This is not a copy but an original Caldera Systems printed CD. I will be pleased to loan it to IBM if they request it.

SCOwned! Includes shocking photographic evidence that may not be suitable for some SCO executives. (Hi, Darl.) Judicial discretion advised.
