That can be dismissed as irrelevant. The damage wasn't the wiretapping, the damage was the costs you incurred because the government wouldn't allow XMission to say whether or not you were the target. You can show those damages occurred whether or not you were actually the target, so that shouldn't matter for standing. If anything it'd only improve standing: if you weren't the target but still had to incur costs solely due to the government's gag order keeping you from knowing the true situation, that only makes the damage greater than if you were the target and would've incurred those costs regardless of the gag order.
