When a tenant of mine bounced several cheques, not just to me but a dozen other
local vendors as well, I was told that it was only fraud if he knew that the
cheque was not going to clear or that the account was closed when the cheque was
written otherwise his fairy godmother could have deposited to money to cover the
bills. For most of the other people he burned it was not worth the court costs
to go after him for the amount of the bills. And even if the court agrees that
he owes the money it doesn't mean he will be able to pay the bill. SCO is now
effectively immune, the only loosers now are their lawyers who are working for
free and IBM who is still has to pay theirs as well.
