Not Kimball - Wells
Authored by: Anonymous on Tuesday, June 11 2013 @ 11:43 PM EDT

It was Magistrate Wells that did away with the bulk of SCOgs "evidence".

Which consisted of new legal theories as well as "code evidence" that SCOg forgot to list specifically by file and line... handed over after the close of discovery none-the-less.

If memory serves correct Kimball then did a review and agreed with Magistrate Wells.

Bankruptcy Court hear the case instead?
Authored by: Steve Martin on Wednesday, June 12 2013 @ 08:38 AM EDT

I'm pretty sure this case already has a new judge (although I note that GL's cast page doesn't seem to list the judges). All the motions were argued, IIRC, before Judge Kimball, except the re-open motions, which have gone to Judge Benson, who's presiding now.

You're partially right. The pending summary judgment motions were briefed and argued before Judge Kimball, but the case was re-assigned from Judge Benson to Judge David Nuffer on March 31 of last year.

We do list the judges in SCO v. IBM and
SCO v. Novell. See the very bottom of
the page, or use the link at the top
By Court or Judge.
