Bankruptcy Court hear the case instead?
Authored by: xtifr on Tuesday, June 11 2013 @ 10:04 PM EDT

I'm pretty sure this case already has a new judge (although I note that GL's cast page doesn't seem to list the judges). All the motions were argued, IIRC, before Judge Kimball, except the re-open motions, which have gone to Judge Benson, who's presiding now.

I admit that the re-open motions have probably forced Judge Benson to skim some of the materials about the case, but that's a far cry from sitting there watching SCO's antics as they happened.

Of course, while SCO probably can't afford much more delay, I suspect they're quite happy to have a new judge on the case, because that judge won't have suffered through their antics in real-time. It took Kimball quite a while to figure out what he was really dealing with. I'm sure it'll take Benson a while to reach the same "is that all you've got?" moment....

Really, though, since Kimball threw out so much of their evidence for not meeting the standards of, well, evidence*, their only real hope at this point is in the appeals. Which won't happen till quite some time in the future. So delay is pretty much inevitable.

* My favorite bit was the whole "infringing by not doing what we also didn't do" argument. I really want to see that reappear in the appeal. It was just so hilarious.
