not so hypothetical question

Lets say two companies filed patents for essentially the same thing several
years apart, but do to overreaching obfuscated language the patent office
allowed both patents to be filed.

We have
Patent A filed first.
Patent B filed second.

There is of course a lawsuit over this. Company A is charging B with violating.
Owner of B is trying to invalidate A. A may have made some technical errors
which allows this. Also there may be some lawyering mistakes.

If patent A is invalidated but it is technically the same thing as patent B.
What is the status of patent B?
Patent B did not cite patent A as precursor work.

City of London target TorrentFreak ..
Authored by: Anonymous on Tuesday, June 04 2013 @ 09:12 PM EDT
"City of London Police inform TorrentFreak that they have begun targeting sites that provide access to unauthorized content for “criminal gain.” The initiative is part of a collaboration with Hollywood studios represented by FACT and the major recording labels of the BPI. In letters being sent out now, police accuse site operators of committing offenses under the Serious Crime Act. The National Fraud Intelligence Bureau further warns that the crimes carry a jail sentence of 10 years." link

The 'City of London` being a legal entity that does not operates under UK jurisdiction. The reason why the UK gov can't reel in the excesses of the financial sector.
