Rovio (angry birds developer) submits to lodsys. From the article (which is really short): Yesterday, in an unexpected turn of events, Lodsys published an eighteen-word blog post simply titled "Rovio," which said the following. Rovio has taken a license to the Lodsys Group portfolio for all of its products, on all platforms.

Obama faces high stakes dilemma in Apple-Samsung battle

An article in the Financial Times about the ruling by the International Trade Commission banning Apple from selling certain iPhones and iPads in the US. (Speculation and background.)

“Samsung has been on a bit of a losing streak. The importance of this case to Samsung cannot be understated,” says Michael Carrier, a professor at Rutgers School of Law in New Jersey which specialises in intellectual property. In April, Google’s Motorola unit lost two big cases involving the same kind of “standards essential patents” that Samsung alleged Apple infringed. SEPs apply to a technology deemed essential to the functioning of any device of its kind and must be licensed at a “fair and reasonable” rate.

Google first lost to Apple at the ITC over a standard patent for touchscreens and then again to Microsoft, when a Seattle judge said the rate Motorola could charge to license its video and WiFi SEPs was far lower than it had hoped.

I congratulate the Financial Times on a well balanced article.

Intel fixes graphics drivers

Last Friday SemiAccurate got a call from Intel and they said something the author thought would never happen, they fixed management problems surrounding Linux drivers. There are now compiled drivers on the net at 01.org.

More shocking is that Intel both acknowledges that they exist on the main driver page and, *BLINK*, links them. This has been a battle SemiAccurate has been fighting for literally years and it is now over, Intel is doing all the right things for the right reasons in almost all the right ways. Who would have believe this day would ever come?

NSA collecting phone records of millions of Americans daily

The National Security Agency is currently collecting the telephone records of millions of US customers of Verizon, one of America's largest telecoms providers, under a top secret court order issued in April.

The order, a copy of which has been obtained by the Guardian, requires Verizon on an "ongoing, daily basis" to give the NSA information on all telephone calls in its systems, both within the US and between the US and other countries.

The document shows for the first time that under the Obama administration the communication records of millions of US citizens are being collected indiscriminately and in bulk – regardless of whether they are suspected of any wrongdoing.

In too deep water

How do you know if you're in too deep water beforehand?

As an analogy. Here is an Indian fellow trying to pronounce Eyjafjallajokull, the Icelandic volcano which erupted from 2010.

While I know I can't pronounce it, I know he can't either.

What kind of legal analysis is normally done beforehand a case is started? What kind of simple betting statistics do lawyers use as an argument before admitting they're in too deep water? Is 1 in 10 a good enough chance if there is a large enough bonus to be had?

HP Slate runs android

Today's ad from Staples. The Slate is prominent with a
mention that it runs Android for 179.95. The desktop and
notebooks have no mention that they come with windows 8. I
wonder if they have removed the windows key and stickers?

Microsoft Reorganizes Itself--Crafty or Confusing?

Microsoft CEO Steve Ballmer appears to be planning a major reorganization. His apparent objective is to help the company move toward becoming a “devices and services company,” as presented in the company’s annual shareholder letter last October.

But the question for investors is whether this is a crafty move that will help Microsoft launch renewed profitable growth or it’s leadership further confusing customers and analysts while leaving Microsoft languishing in stalled markets. With shares up some 31% in the last six months, it is a good time to decide if an investor should buy, hold or sell.

There are a lot of things not going well for Microsoft right now.

Everyone knows PC sales have started dropping. IDC recently lowered its forecast for 2013 from a decline of 1.3% to negative 7.8%. The mobile market is already larger than PC sales, and IDC now expects tablet sales (excluding smartphones) to surpass PCs in 2015. Because the PC is Microsoft’s “core” market, producing almost all the company’s profitability, declining sales are not a good thing.

Microsoft hoped Windows 8 would reverse the trend. That has not happened. Unfortunately, ever since its launch Windows 8 has underperformed the horrific sales of Vista. Eight months into the new product it is selling at about half the rate Vista did back in 2007, and that was the worst launch in company history. Win8 still has fewer users than Vista, and at 4% share a tenth that of market leaders Windows 7 and XP.

Nokia Investors Are Sick Of Waiting Around For Changes, Want To Leave Microsoft

Many shareholders at the annual general meeting in Helsinki said Elop should reconsider his 2011 decision to switch to the phone operating software made by his former employer Microsoft.

The transition to Windows Phone from Nokia's own Symbian system was meant to take two years. That period is now over, and while recent results have shown growth in sales of Lumia smartphones using Windows Phone 8 software, the volumes pale in comparison with the top Samsung and Apple models, and sales of its regular mobile phones have plunged in the meantime.

"Maybe they could go back to Google and say we also want to go with Android. Even if it hurts. Microsoft, they've had their chances, and are not managing to take off," he said.

In fact, we know from a previous article that Nokia's "sales" were not to the end user, but just channel stuffing to the carriers, who are overstocked to critical levels with Nokia phones. Watch for drastic price drops later on as these same channels become anxious to unload these phones to make room for the new fall releases from all suppliers.

Below the article, there is a panel that features "Microsoft gadgets that failed" and reviews the Kin phones and other failures. Below that there is an image of Nokia Lumia 720, which I first thought was just another part of the failed devices panel, but which in fact, was an Engadget review. The metaphor speaks clearly. It is only a few pixels away from being included in the failed devices category.
