amicus briefs in Oracle versus Google's appeal, and they all say the same thing:

Groklaw has played at least a small role in starting this avalanche, and when

What do folks think of this?
I have mixed feelings, On the one hand, MFN clauses greatly simplify price
negotiations, but as we are seeing here they can cause a lot of headachea as
well.
Thinking about it, I think that it's perfectly fine to negotiate a MFN clause on
the wholesale price (what the distributor pays the producer), but if you apply
it to the retail price (what the consumer pays the distributor), bad things
start to happen
