This has stunning implications. It immediately calls for
review in many cases. It calls for the identity of patent
owners and their counsel and family. It may help undo some
settlements and call for new trials if conflicts, or as some
prefer to say "coincidences of interest" were undisclosed.
The trolls and their families and their lawyers and families
are going to have to disclose "interests." Every patent
thing this firm did is now suspect.
This scheming backdrop with the "inventor" and the lawyer's
wife is very typical. Invention has nothing to do with it.
It is claim jumping. The only thing being invented is
patent claims, thanks to the Federal Circuit and the USPTO.
These McAleese disclosures can well inspire reform. This
is severe. McAleese is gone from the firm, but the firm is
accountable. Everyone in every major patent battle is going
to look for more such conflicts. Impropriety or merely the
appearance of impropriety shall rock the land.

Lowlifes like Prenda used to exist for most of us only in cheap paperback
detective novels. Now a gray flannel
Main Street firm has to explain the
behaviour of one of its partners towards a world brand leader. The
Reddit thread seems to have a lot of sympathy for the lawyer
since so far it looks like "only an ethical
question", there doesn't seem to be
any criminal activity. Like there is no criminal activity in patenting rounded
corners, or packaging rotten derivatives.
Ethical behaviour is one of
the foundations of the rule of law. Many people learn their ethics at grade
school,
out in the yard. They should learn their common sense there too. I
guess it will take two or three generations
to grow this out of society, only
if there is a common will to do so. The process could be speeded up by a few
well chosen public executions, but I doubt there's any will for that.
