to merely point at 102(b) repeatedly without actually articulating which part of
102(b) you are talking about in a brief that is filled with factual and
technical innacuracies is akin to jumping up and down and yelling "it
should be there, it should be there please don't listen to Oracle"


What about 102(b) ? Why?

Explain it, explain the conceptual nature, point to the word concept. and then
you have an argument.

Don't just keep saying look we have an exception clause and didn't billy joe do
something amazing when he cloned another API and why should he be made to pay
for that because if he was it wouldn't have happened.
