I think the problem is the Police are in a bit of a catch-22.

If the disks have no evidential value, the police have to return them.

But if the police can't read them, they don't know if they have to return them
or not!

Thing is, was the original seizure warrant valid or not? If it wasn't valid the
disks should be returned end of. If it was valid, then Kim is in a bit of a bind
too - in order to get his disks back, he has to let the police rifle through
them.
