Copyright is only violated if either the binary blob that is compiled from the
source code in its entirety, or if the source code , or substantial chunks
thereof are copied.

Actually, I suggest you look into the history of that. Some of us were around
and remember it.

IBM were most upset. IBM would have killed it stone dead if they could. Compaq
made sure that they couldn't.

The Compaq BIOS was a clone of the IBM BIOS - hence the term "clone
PCs". In common parlance, yes the Compaq BIOS was a copy of the IBM BIOS.
But because Compaq didn't actually copy it, copyright couldn't touch it.
