Motorola was forced to defend itself and is using whatever ammunition it has. I
may be wrong but I don't believe they fired first only returned fire. I do agree
that software patents are in dire need of extinction. I did a lot of these
things in assembler language in the dark ages.

It's deplorable, yes, but:

Hitting someone in the face is deplorable too, but if that prevents him from
sticking a knife in you, you'd do it.
Fighting back is never pretty. But it's unavoidable.

Motorola's patents are also (largely) stupid too

One of them "winning" will have vastly different consequences
to the other "winning". Many people care about this.

When both sides are using stupid weapons, pick which you
want, and live with the consequences.

Since you posted anonymously it's impossible to tell whether
you're new here and really don't know that PJ has answered
that stupid question about 3,000 times.

So let me lay it out for you. Unequivocally, software needs
to get a divorce from patents. There should be no software
patents, period.

That said, as long as we have software patents, FOSS users
should be able to use them as defensive weapons.

And by the way, do you know how many of Motorola's SEPs are
software patents?

Whatever Motorola is doing doesn't make these Apple patents any less ridiculous.
Nor it makes Apple's strategy any less anti-innovation.

Google purchased Motorola to pressure Microsoft and Apple to cross license or
failing that to back the heck off.


hasn't worked yet, but I'm betting if Glass takes off Google will make sure
Apple and Microsoft are stuck outside until they sign on a dotted line and
actually compete rather than litigating.

Motorola invented the cell phone. Their patents aren't "meritless".
"Rectangular with rounded corners" is.
