Because all the proponents of patents point out that industries would not exist
without patents as no one would bother to create if there was no protection.

BUT all it takes is ONE counter example to prove a statement false.

The fashion industry has NO protection and yet it thrives - much better that
those industries which do have protection (in the form of patents) - but the
statement says that nobody would bother and the industry would fail; as it
doesn't fail the statement must be false.

And yet this statement is the main plank of those who want to keep patents.
