I tried to distinguish this as an example of software that should be patentable, rather than something that is patentable.

MP3 was IIRC a hardware patent

It required made for purpose DSP chips. It only became software
when general purpose cpu chips were able to do this work in
real time. It was this later development that forced Fraunhofer
to not enforce the patent against software codecs.
