its also a Google Glass feature called Voice Actions . Logically a video camera is a superset of a digital still camera.

Who is to say that the patent office even checks their local 'Best Buy' or Target before even approving something?

Since there are several voice activated cameras on the market at the time of submission, the patent should never be approved unless Microsoft says something specific in it to significantly narrow the field of application, just to get it through. After a restricted approval by USPTO you bet M$ will update the patent after the fact to change the scope of the patent to give them the maximum damage capability.

Sure, first to file allows you to file an application over somebody
else's widget. And since it doesn't already have a patent USPTO
won't know anything about it. Voila, instant patent.
