If that's true, and that constitutes a proper "qualifying
offer" under the terms of the consent decree, then I don't
understand why the whole issue isn't moot. Why is motorola
conceding they have additional steps to follow if they already

If Motorola has made an offer, then the ball is in Apple's court. If Apple won't
play, then there is no just reason why Motorola shouldn't be able to enforce and
get an injunction.
Given Apple's wordplay and sword-dancing, I strongly suspect they are
"being economical with the truth". And with a Judge who seems only too
happy to take them at their word, well, I guess this is the obvious result.
