... but it doesn't mean the Supremes will accept it.

Let's say Congress creates a Law that says:

    Even abstract concepts and Laws of Nature are patentable
The Supremes do have the power to push back via the Constitution saying the Law is anti-constitutional.

However, my point is this:

    Whether or not the Law has been made "official" via Congress - if it is in reality being applied - it is Law already!
Having it "official by Congress" does not alter the harm it's already doing.

We're already battling both the Courts and Congress on software patentability. That wouldn't change if Congress made the battle more official.
