Well, if Samsung appeals and says that the court declined to consider whether
the patents were invalid, then all bets are off...

What Samsung could really do with is an appeals court telling the District Court
to re-evaluate whether the patents are valid. Dunno how likely they are to get
it. But iirc hasn't the case been sent to the 9th circuit on appeal because the
Judge dismissed Samsung's patent claims? If Samsung do get it referred to the
Federal Circuit I think there's a very good chance patent validity will be up in
the air, and then Apple are going to find their patents rather clobbered ...
