Not necessarily true for item 4. If the courts decision comes before the USPTO
rules "TOUGH".

Say that step 3 takes years to play out - how much interest on the 10 million
has the loser lost? And is 10 million worth the same now as it was then?

Even with Escrow accounts, I'm not sure that they can accrue interest - and even
if they can, probably not at the same rates as money freely invested - and if
they can invest, who gets to direct that investment?
