The circumstances were a bit different ... but yes you're right.

Firstly, don't forget RIM were caught in a "fraud on the court". I
strongly suspect the Judge, having caught them lying, just wasn't prepared to
give them the benefit of the doubt. Moral: don't pee off the judge.

And secondly, the Judge was going to impose an injunction shutting down their
infrastructure. So they took a licence. Which they couldn't renege on when the
patent was invalidated.

Here, the only "nuclear" weapon the Judge has available is an import
ban which, as we've seen, will do more damage to Apple than Samsung :-)
