Sadly, it's been that way (from my experience) for quite some time.

School ground bullies tend to get away with their bullying while the kid who takes steps (including informing the "authorities" as to what's happening) gets punished ("no one likes a tattle tale").

Hopefully after their review of the Motorola/Google situation, the EU Anti-competition commission will take a good look into Apple's activities including their public statements to which the UK Court corrected.
