I'd be tempted to ask the Judge Koh why he's attempting to make a mockery of the
law rather than enforcing the meaning and intent of the law.
If he's aware that the patents were invalid when submitted, then he's aware that
any findings based on those are invalid and must wait until the answer is known
whether they are valid or not. Period.
Any other action appears to be biased towards one company and does not follow
the law. Which opens the Judge to peer review and possible removal from the
bench for such a blatant and obvious side-stepping of the law.
