to the public making use of the invention. that would be your misunderstanding
of what I intended.
I intended to speak to the public immediately being
able to make use of the knowledge that the invention discloses.
Yes -
those that want to make use of the specific invention need to appropriately
license if the patent holder is willing to do so.
Those who do not want
to license - or can't because the patent holder is not willing to license - can
quite legally research and innovate around the patent without paying the patent
holder anything.
They can do this because the knowledge is immediately
available.
