if there was a record showing that microsoft made a counter offer that was
summarily rejected by motorola or that motorola refused to move from their
opening position over time. except there isn't one because that didn't
happen. if i was microsoft and i thought it would play out that way i
would have engaged so i would have that record to use in court after. that
they didn't leads me to believe they didn't expect to play out like that
at all.
your accusations of supposed bad faith on the part of motorola are purely
speculation and based on a questionable premise. there is an established
process for rand licensing: it is to negotiate. one party engaged in the
standard process and one party did not. the bad faith begins and ends
there.
