This court dispute was about a business contract concerning Worldwide
licensing agreements between two US based companies.
Moto filed suit in Germany hoping to get a fast win in order to put more
pressure on MS to settle..
The judge realized this, and right or wrong, claimed jurisdiction on staying
the German import injunction. The reasoning, that the dispute includes
worldwide license, and both the parent companies are based in the US.
Germany and the US are using different analytical models and laws.
Germany is much quicker to impose injunctions, before looking at all the
defenses and patent nullify arguements, than the US.
