Except this is your pet theory for rationalizing Moto's problem away, not
reality.

Yes, Motorola has stated that Microsoft was obligated to try to negotiate, but
they've never, for one second, stepped back from claiming that 2.25% of the
total
product is in fact a RAND rate. They've never once argued that 2.25% is not RAND

and that they actually want something between 0 and 2.25% of the entire
product.

So, you can theorize that they think otherwise and that they could show scores
of
companies that took an initial 2.25% of the total product an they then
negotiated
it done to something "reasonable", but that's not Motorola's theory
and they
haven't provided any evidence of any such negotiations leading to any such
patent negotiated patent signings.

In such a case, it's not my problem to disprove that this has never happened;
it's
Motorola's problem that they never compromised and offered any evidence of
such a negotiation happening... if any such negotiations did in fact happen,
which I am skeptical of.
