Paying for invalid claims is unfair?

Someone should tell that to judges presiding over child support cases. There
have been cases where it was later determined that a man wasn't the father of a
child and was never married to the mother or anything of the sort -- she lied --
and the judge ruled "in favor of the child." I'm sorry, but picking
on an innocent adult in order to pay child support to a mother who lied to get
it? Fair? There are judges who seem to think so.

Sorry it seems off-topic, but the notion of being required to pay for damages
even after a patent is determined to be invalid is definitely unfair and
nightmarishly so.

Wonder if Samsung could use the idea that Apple intentionally filed patents that
it KNEW were invalid (hey, the same materials that are invalidating their
patents was available when they filed) just to see if they could get away with
it.

Fraudulent claims filed with officials at the USPTO - hmmm some kind of perjury,
huckstery, chicanery

Consequences - forced to repay any fees, license costs, penalties and judicial
payouts over the falsely filed patents.
