Just a question.
Don't the legal team for Apple get paid a percentage of the win. AND, if the
team gets reduced damages, that reduces their percentage.
If so, then, I wonder who is in the real hurry?
Apple, or their lawyers?[ Reply to This | Parent | # ]

Disclaimer: I'm just a legal lay-person, with no formal legal training, who is
sharing an opinion.
I am sure a judge could overrule any stipulations that he considers to not be
advancing the case (e.g., "We stipulate that the bailiff will be serving us
tea in the judge's chambers").
However, for any reasonable mutually-agreed-upon stipulation, I imagine it would
be exceedingly unlikely for His Honor to declare, "I reject your
stipulation, and am requiring both parties to take opposing stances, and fully
brief and argue the issue they are attempting to stipulate."
If someone knows of a case where that has happened, I'd be delighted to learn of
it.
