I don't really get it.
What appeals court in their right mind would grant Apple ANYTHING on a
patent that was invalidated by USPTO? (set aside the fact that there are big
questions around how the jury arrived to the 'infringement' conclusion)
Does it really help them to go into appeals now? Do they actually stand a (non-

If the appeal goes ahead before the validity of the patents is settled, then
clearly there is a danger of Samsung suffering irrepairable harm, in that they
may have to pay for infringing invalid patents - payments that cannot be
recovered.
On the other hand, if the appeal is delayed until the final status of the
patents is known, then Apple can be awarded the appropriate figure.[ Reply to This | Parent | # ]
