I'm sure that a new trial is perfectly capable of having new mistakes, following
the cycle of trial, appeal, remand, trial, appeal, remand, ...

Wait - I missed the part where the remand is appealed to the Supremes.

Basically, what Samsung is saying is that what the judge effectively did was
decide Samsung was guilty and told the jury to tell her how much.

I find Samsungs argument quite plausible, and certainly an appeal court will
probably find enough problems with the trial to not risk this going all the way
to the top.
