It's stupid analogy to begin with. Even if the airplane was
invented today it wouldn't have an electronic controller
because the feedback from the controls is critical to
keeping the aircraft in the air. Even if an electronic
system is used it doesn't necessarily need to have a
microprocessor or be run by software. However, even if it
did use software, the software doesn't need to be patented
to protect the invention of an aircraft control system. The
software is just another part, like a bolt and doesn't need
protection on it's own. It's the testing data the software
is written to that has the value.
