The portion of the Office Action included in the main article to which you refer
was apparently the Examiner's starting point, quoted there out of context in a
confusing manner. I believe the quoted remarks were the position presented in
the previous Office Action. Since that action, the representatives of the
Applicant submitted a rebuttal argument which the examiner has considered. The
present Office Action is in the form of a Reply to the rebuttal.

On page 21 of the 83 page Office Action, the Examiner indicates that the
rejections under Reason D have "been removed" in view of a declaration
made by a Mr. Ording.
