You're missing the point. In an adversarial system, you have
to view it from both parties' perspectives.
From Samsung's point of view, they think they can prevail at
the appellate state; but more importantly, they don't want
to litigate these issues right now (this has to do with
leverage).
From Apple's point of view, they want to be able to get all
of these issues taken up (incl. possibility of injunction,
pending Fed. Cir. determination); for them, all delays
accrue a benefit to Samsung.
There is no "right" answer to this- that's the problem.
There's two competing answers that the judge has to chose
