What's what I thought also. Someone familiar with H.264 claimed (I think on an
lwn.net discussion) that it and vp8 use so similar techniques (the same that
most other state of the art codecs use also) that it is hard for one to infringe
on a patent without the other infringing also.
I am not an expert on video codecs, so cannot comment on if this is true.
