The bit of Omega v Costco which has been scotched is the notion that "First Sale" would "impermissibly extend" the Copyright Act overseas. Breyer goes to some lengths to say otherwise.

The court in Omega v Costco did think something made abroad but imported at the behest of the copyright holder could still attract First Sale protection. What Breyer is saying is that all this is linguistic nonsense, that there's lots of authority to the effect that Copyright law can apply overseas, and that the words "lawfully made under this title ... either do cover copies lawfully made abroad or they do not".
