One thing that I don't see expressed by the victims of NPE/PAEs is the benefits
of "the NewEgg Approach". NewEgg defends patents not merely by seeking
dismissal, but by doing their best to get the patent overturned.
Individual case costs for defense are high, but if the defendants in these suits
pursue the case to review and overturn the patent, rather than merely to
dismissal of the case against their company, it benefits the system as a whole
and reduces the risks for everyone. If the majority of victims take this
approach, it's like an open-source patent revoking project. Everyone contributes
to getting bad patents overturned on their own, and the community at large
benefits by not having to repeat the same patent defens over and over.[ Reply to This | Parent | # ]
