My bet is the judge will stay the case. Apple will appeal. The Appeals court
will manage to not rule on the appeal until after they rule on AvP 1. Then they
will kick AvP 2 back to Koh to revisit in light of the AvP 1 ruiling.[ Reply to This | Parent | # ]

Yes, but she brought it all on herself.
She could have done like William Alsup and severely narrowed the patents and
claims "to a trialable number".
This might have avoided the ridiculous jury verdict.
She could have not shown so much bias toward Apple early on.
Another fix that was applied to both Intel and Motorola a few decades ago was to
grant both companies injunctions on each other's products. They reached an
agreement the very next day. Imagine that.
I imagine there are lots of other options a judge might have had available.
So I'm sorry if I don't have a lot of sympathy for judge Koh.
