So we can all agree that Standards Essential Patents are a necessity
in technology. Without them, each company would be implementing the same
technologies in their own way, effectively re-inventing the wheel every time.
And none of these technologies would play ball with each
other.
Scrub the "Essential Patents" part if you want everyone
to agree. Personally I think standards should be totally unencumbered and freely
available. Let the market choose the cheapest, fastest, locally sourced, out
sourced, or most reliable implementation as their needs dictate.

Err... that's what a Standard (not an SEP,
two different things) is for.
So, the standards setting
organizations made it possible to still get a patent on your ideas for your hard
work...
Nope... that's the Job of the Patent Office - such as the
USPTO. And the USPTO is not involved in any standards body - like IEEE - that I'm aware
of.
The rest of your assertions I'm not in a position to have an opinion
on.
Would such a sliding scale make sense? Seems to. But it also seems
to be a breach of the "non discriminatory" part of FRAND.
