MS and Apple are claiming they are being discriminated
against. Has it been documented/proven? My recollection is
that they refused license under almost any terms. MS is

from what I remember of the public documents Moto gave their standard opening
offer (which they give to everyone) - no discrimination there - and MS (at
least) didn't bother with a counter offer but went straight to litigation.
What proof do you have that the final agreements that moto made with their
existing licencees does not equate to the initial opening offer, or even
greater? Actually meaning that moto is being unfair with respect to MS in that
they are actually asking ms for less than they are effectively getting from
their current licencees (from cross-licensing; something of which ms does not

NO. F in FRAND means Fair. And if a company choose that
"Fair" means that "you don't sue me and I don't sue you, you

If Motorola are asking MS to pay so much more than anybody else, how come are MS
screaming blue murder because Motorola said "our standard rate *for*
*everyone* is 2.25%"?
Motorola offered MS the exact same terms they always offer everyone. MS declined
to negotiate.
