While I don't know what devices the patents cover Moto might have figured
that MS is not going to sell many phones or tablets so the low rate in this one

instance is not a bad deal. They don't forego a lot of cash because the
number of units will be so low and they seriously upset MS, their legal team
and (possibly) the US judge who now has something completely different on
his plate.
