No, I'm pretty sure that the Circuit Court of Appeals is obligated to hear each
and every appeal from the District court. It is only the "en banc"
requests that can be denied. Oh, and the Supreme Court has the discretion to

Could an amicus brief be filed by FSF or EFF about the connections between the
companies?
Also could it be mentioned that there would be a serious monopoly power
involved?
Is one allowed to write, without filing a full brief, to the judges pointing out
