Well, there WAS a hurricane Sandy, and I'm sure there were soybeans in that
area. There WAS a hurricane Katrina, etc. So even if his statement held water,
there would still be that specific situation to deal with legally, even if it
were not the most common case.

Pollen drift in the wind is the problem that Monsanto have used to
hammer farmers elsewhere on canola crops. That was the basis for
Kagan's question, but he confused that with the different behaviour
of soybeans. Soybeans have a "complete" flower, they are self
pollinating. Also the seeds are heavier than most crop seeds,
so it would take hurricane like winds to move them onto
neighboring land.
