How to measure "a vibrant market"?

I'm just suggesting that the Trade Mark Register might look at
total installations, and gross annual turnover of a programming
language vs. eg. a motorcycle, or a carbonated beverage,
bearing the same name. The relative longterm values of
each to the overall economy is an interesting question.
The fact that the numbers may not be available for an
open sourced software would put a spoke thru the
TMR's calculations.
