You're exactly right. A crime has to be proven. While it is Ortiz's
responsibility to bring evidence to the trial that she believes proves his
guilt, she does not make the final verdict. She is only responsible for
charging Swartz with what she believes she can reasonably get a conviction for,
and then gather and show the evidence to a judge and jury. My response is to
those shouting about prosecutorial abuse. If you believe that she charged
Swartz with crimes he didn't commit that is one thing. If you believe that she
bullied Swartz by telling him what the maximum amount of time he could serve,
should he be convicted on the charges she in bringing, in order to get a plea
deal that is another matter.
