If you are going
to accuse Ortiz of misconduct in her charging of Swartz in this manner, then you
have to show that he was not violating the laws under which he was being
charged. In everything that I have read about the case, I don't see much
contention that he was violating those laws. The discussion seems, instead, to
focus more on the potential severity of the punishment out weighing the severity
