"SHUT UP AND DON'T TALK TO THE GOVERNMENT. They are not your
friend."
Is anyone else distinctly worried about
this?
The thing to worry about is that lying to Federal
Investigators, not under oath, is a Federal Offense.
And "lying"
is defined by the Investigators, it doesn't have to be a deliberate lie. Just a
faulty memory can land you in jail. [ Reply to This | Parent | # ]

I wonder if the Feds think they have Avenging Angel warrants when
the crimes of conspiracy, false statement, obstruction, aiding and abetting,
are more serious than the original crime of whale sushi. Oh yes,
I understand these others are things that should be dissuaded
in a decent society, but we end up with cases like Swartz where
the crime was split into separate acts to derive aiding and abetting
for a solo perp.
My dictionary requires conspiracy to be secret. Did anybody ever get
off a conspiracy charge by showing the only people who didn't know
were the Feds? Yes, I've seen the cases where someone who knew
but stood back and did nothing was also hauled in for the sole charge
of conspiracy.
Maybe the Feds should be hauled in on a #412.

but with ANY law enforcement official (police and DAs). ALWAYS have a lawyer
present, even when giving a witness statement. If you witness a crime, you are
automatically a suspect, especially if you're the only witness. Carefully give
the facts at the scene, but get a lawyer for a station interview. Safer to get
a lawyer first, then go on record at the station.[ Reply to This | Parent | # ]
