The remainder may be allowed to read software patents, but would those who are
allowed to read them be of the "skilled in the arts" nature, or in a
position to use said patents?
I am quite at liberty to read patents about yacht hulls, but the chance of me
ever infringing one is extremely small as it's extremely unlikely that I will
ever be in a position to work on a yacht hull.
Although it is correct to say that if "Most are not allowed to read",
then "some are allowed to read" has no implication of what they can do
with said reading.
Similarly, "Most of the time learns nothing" does not imply that
"some of the time learns something /useful to the field of the
patent/" is true. The reader could learn that "software patents do
not give enough detail for the invention (sic) to be constructed" - still
absolutely nothing about the claimed invention has been learnt, but something
about software patents in general has been learnt![ Reply to This | Parent | # ]
