illegal?

Please point to the particular clauses in the contract that spell this out. Specifically: The contract Google/Motorola signed.

That would conflict with sections 3.1.7 and 3.3 of the license which say that covered affiliates must be identified in writing, either at the time the agreement is signed (3.1.7), each year by the end of February (3.3) or when the licensee wants to change the list (3.3).
